Court fines Da Torpedo 50,000 baht for insulting Sondhi

Da Torpedo was acquitted on a charge of besieging the ASTV office, but was fined for insulting Sondhi Limthongkul.

On July 28, Bangkok South Criminal Court ruled on the charges against Daranee Charnchoengsilapakul or Da Torpedo of instigating unrest, detaining others, damaging property, trespass and defamation, in an incident on 1 June 2007, when she led a group of about 50-70 red shirts to protest at the ASTV office on Phra Athit Road.

The court acquitted her on the charge of besieging the ASTV office, but found her guilty of defaming Sondhi Limthongkul, owner of the ASTV station and co-leader of the People’s Alliance for Democracy.

However, the fine of 50,000 baht does not need to be paid because her time in prison has already exceeded the punishment.  She must remain in Klong Prem Prison pending trial for lèse majesté for which she has been detained for one year already without bail.

On the same day, the court also held a hearing on the lèse majesté case, in which Asst Prof Suthachai Yimprasert, history lecturer from Chulalongkorn University, testified as a defence witness.

Defamation... bringing up the facts of the matter, the truth, when those facts might cause another's reputation to fall into disrepute is "defamation".

That that is considered a crime, especially in the case of defaming a professional defamer like Sondhi, tells you all you need to now about the Thai courts.

Two standards. One for them. One for us.

Interesting, too, that she's

Yes, right Sondhi Limthongkul

He is mad dog of the EAST.

I sort of agree here:-) :-)

I sort of agree here:-) :-) Now I'm trying to look for the link abt what he said abt thePreah Vihear issue.

He proposed a what-to-do list to be taken by the next government, including:
..............

“We would close all 40 Thai-Cambodian border checkpoints, and ban all flights to Phnom Penh and Siam Reap from Bangkok; 70% of flights to the two destinations are from Bangkok.
.................
Cambodia would be hopping mad, but we would not bother because Cambodia would not have the nerve to fight us. They can make noises and threats because our own people are traitors. But if they see that Thai soldiers have a firm stand, the (new) Thai government has a firm stand, and the Thai people are ready to sacrifice their lives for sovereignty, they will back off. Cambodia can do nothing but to count on Thailand. If they want to count on Vietnam, let them do so, but problems would surely arise between the real Cambodians and the Vietnamese in future.

China openly makes friends with everybody, but furtively China knows that, between Thailand and Cambodia, it prefers Thailand.

When we declare all overlapping areas ours, Cambodia will surely protest. But we will not argue. We’ll send our battleships to seize any islands and islets we spot, or anchor our battleships in the overlapping sea territory.

Until the UN sets up a committee to mediate the dispute over sea areas between Thailand and Cambodia, we would sit at the table, and would not be an underdog like we are today, but would hold the upper hand. At that time western companies and countries who look for sources of energy know that the new Thai government is not a traitor, so they will take the Thai side..........

After we resign from UNESCO, we would officially notify the 7 member countries of the World Heritage Committee that we would not allow them to enter our country to restore the Preah Vihear temple. They would have to fly helicopters from Cambodia to reach the temple. We would not even allow them to come out to use toilets on Thai soil.
..........

How many defamation cases

How many defamation cases Sondhi is facing now? He was found guilty at least once, for LM of all charges.

He is also grasping for last straws in bankruptcy case.

Who can honestly say he gets free rides from the courts?

As for Darunee - I have no idea what she said about him and can't offer any opinion on whether she was guilty or not.

Anyone can clarify that? Before declaring her a victim?

Thanks for the "Cambodia" list, btw. Interestingly, he doesn't claim ownership of the temple here.

Trep, Sondi claimed the

Trep, Sondi claimed the ownership of the temple, that is the official position of PAD.

Joy, I remember he made this speach in a rally, I think he put it as a dream he had a day before. (Maybe) Yes, it's a right-wing agitation, but his main point is that Thailand had upper hand over Cambodia militarily, so do not have to be afraid of taking a tougher diplomatic stance on the temple.

I don't know if Thailand is raelly tougher than Cambodia militarily. How about the guerilla war on the boarder with them? Maybe Thai should remember the massacre done by KR in several Thai villages on the boarder 20 yeas ago. This kind of thing might happen again. And if the soliders fatality reached 300, for example, how the Thai public would respond to the situation? I think the same level of death tall will be accepted differently in Cambodia.

Somsak, I think Thai people

Somsak,
I think Thai people have long been taught to regard our neighboring countries as enemies, or as those we can't trust or as those who want to steal our lands, and I suppose the same thing happens with Burmese or Cambodian prople (regarding their attitude toward Thailand/Thai people). This mutual hostility is no good and the only way to lessen it is to make SE people realize that our histories (esp. narratives abt our neighbors) are biased and mainly created to justify the ruler's actions/decisions (e.g to invade neigboring countries or to 'unify' the people so that they can easily be led to fight against other nations (for the sake of the rulers))

Joy, but the problem is that

Joy, but the problem is that Hun Sen will say the things in the same nature.(do you rememer his "ultimatum" which nobody took seriously? ) if he needs to bluff.

somsak, i think the hope of

somsak, i think the hope of creating better relations among Asian neigbors lie in ordinary people, not leaders. In fact, children and young people are the better hope because they are still open to new way of thinking/new sorts of friendship. Now I remember one short story by Rattawaut Lapcharoensap (in Sightseeing): Priciscilla: the Cambodian. I think it's a really good story because it shows how children are able to break through/challenge stereoptypes of the Cambodian refugees and able to form lovely friendship with them (adults on the other hand, are too quick to find scapegoats and too stubborn to change their perceptions of other people/other nationalities). The story does not have a happy ending. In the end, the Cambodian refugess are still maltreated but at least it shows that the adults are wrong and not as compassionate as the children. I'm not idealizing children though ...

Trep, what I mean is : "PV

Trep, what I mean is : "PV temple is Thai's" is the PAD's official position. I think demand to get back the temple by force is just a bluff, or just a part of pep talk in the rally.

Joy, I'm not encouraging a war but I mean all the players in the both sides know the war is not an easy job. So Thailand and Cambodia will not easily get into that anyway. I think, because Sondhi knew it, he played with such an easy rethoric.

In addition to numerous

In addition to numerous defamation charges, perhaps they can get Sondhi L (and others) on inciting hatred/violence?
(I seem to recall there were military casualties on both sides in the temple borderskirmishes over recent months)

Probably no need though, as he's already facing the death sentence for the airport occupation.
btw, I probably go against many here in saying it, but I think the terrorism charge is as ridiculous as Luksana's charges againmst the FCCT
(you would expect terrorists would meet some resistance:)

Sorry, I know I should not be joking/mocking/sarcastic on such serious matters, but its all I know.

So do you think they should be charged for tresspassing instead? Tresspassing the airport's courtyard for a week? Unfortunately, the airport authority failed to protect the vicinity, and the policeforce are temporary lame. So the airport authority decided to call for a halt to all activities for safety sake. May be it's nobody's fault, for such a supernatural phenomenon.

Personally I don't care what charges will they get. But I'm keen to know the loss from the incident ( hundred of billion as claimed by some) fall into whose accountability? And also keen to know how on earth it happened, and most of all, how to prevent this kind of supernatural disaster?

Doctor J: If the only legal

Doctor J: If the only legal choices are Trespassing or Terrorism, then yes, I would choose trespassing as the more realistic charge.

It was clear that more than the PAD leadership are culpable in that sorry saga, however I agree such things should never be allowed to happen again.

Talk of lost amounts and accountability seem pointless to me, and will only perpetuate the divisions.

Both the reds & yellows have had their lawless field days - its time to draw a line in the sand, and say no more - from now on, everyone needs to be accountable for their actions, including military, police, politicians, protest leaders and the protesters.
